Healthcare practices want to use AI. They see other industries automating and wonder why they can't do the same. Then someone mentions HIPAA and the whole conversation stalls.
Here's the thing: HIPAA doesn't ban AI. It doesn't ban automation. It just requires you to handle protected health information (PHI) carefully. You can absolutely build AI-powered workflows that are compliant. You just need to do it right.
Quick HIPAA Refresher
HIPAA's core requirement is pretty simple: protect patient data. That means controlling who can access it, encrypting it, logging who touched it, and having agreements with anyone who handles it on your behalf.
The relevant piece for automation is the Business Associate Agreement (BAA). Any third party that handles PHI on your behalf needs to sign one. This includes your EHR vendor, your payment processor, and yes, your automation platform.
Where AI Gets Tricky
The challenge with AI (specifically large language models like GPT-4 or Claude) is that they're cloud services. Your data goes to their servers for processing. That's a HIPAA concern.
The good news: both OpenAI and Anthropic now offer HIPAA-compliant API access with BAAs. You can use these models with PHI, as long as you're on their enterprise plans and have the agreements in place.
The free ChatGPT interface? Not compliant. Don't paste patient data in there. But the API with proper agreements? That's a different story.
Building Compliant Workflows
Here's the architecture pattern we use for healthcare clients:
Self-hosted workflow engine. We run n8n on dedicated infrastructure (usually AWS or Azure with HIPAA-eligible services). This means PHI never touches shared servers. We have full control over encryption, access, and logging.
BAA-covered AI APIs. When workflows need AI processing (document extraction, classification, etc.), they call APIs from providers with BAAs. The data is encrypted in transit and the provider commits to HIPAA compliance.
Audit logging. Every piece of data that moves through the workflow is logged. Who accessed it, when, what happened. This is crucial for HIPAA's accountability requirements.
Encryption everywhere. Data encrypted at rest, encrypted in transit, encrypted in backups. No exceptions.
What About Consumer AI Tools?
I get asked about Zapier, Make, and similar platforms. Can you use them with PHI?
Short answer: check if they offer BAAs. Zapier has a HIPAA-compliant enterprise tier. Make.com's situation is less clear. For anything touching PHI, I generally recommend self-hosted solutions where you have complete control.
The issue isn't just whether the platform signs a BAA. It's also about all the connections. If your workflow sends data through six different cloud services, you need BAAs with all of them. That gets complicated fast.
Common Compliant Use Cases
Here are some AI workflows we've built that pass HIPAA muster:
Patient intake processing. Forms come in, AI extracts the data, populates the EHR. All processing happens on BAA-covered infrastructure. PHI never touches non-compliant systems.
Appointment scheduling assistants. AI handles patient messages about scheduling. The key: the AI runs on compliant infrastructure and the conversation logs are properly secured.
Document classification. Incoming faxes and documents get automatically sorted by type. The AI reads the document, categorizes it, routes it to the right queue.
Referral follow-up. AI monitors referral status and sends appropriate follow-ups to patients. All patient data stays within compliant systems.
The Documentation Piece
HIPAA isn't just about technical controls. You need documentation proving you've thought this through.
Risk assessments: What PHI does the workflow handle? What are the risks? How are they mitigated?
Policies and procedures: Who can access the workflow? How are changes managed? What happens if there's a breach?
BAA inventory: Every vendor that touches PHI, documented with their BAA status.
This documentation isn't optional. When OCR comes knocking (or your cyber insurance wants to see your compliance posture), you need to have it.
Getting Started
If you're a healthcare org wanting to explore AI automation, here's my advice:
Start with workflows that don't involve PHI. Plenty of administrative tasks (appointment reminders to confirmed patients, internal notifications, report generation from aggregated data) can be automated without touching individual patient records.
Build your compliance foundation. Get your BAA inventory in order. Document your policies. Make sure your IT infrastructure is HIPAA-eligible.
Then expand carefully. Each new workflow that touches PHI should go through a risk assessment. Don't rush it.
